1st Offense - Blood Alcohol Reading of 0.08% or higher, but less than 0.10% ● $575-$775 fines and charges ● driver's license suspension for a period of 3 months ● IDRC (Intoxicated Driver Resource Center) 12 to 48 hours ● possible imprisonment up to 30 days ● additional conditions may be imposed
1st Offense - Blood Alcohol Reading of 0.10% or higher ● $625 to $825 ● driver's license suspension 7 months to 1 year ● IDRC (Intoxicated Driver Resource Center) 12 to 48 hours ● possible imprisonment up to 30 days ● additional conditions may be imposed 2nd Offense - Blood Alcohol Reading of 0.08% or higher ● $825 to $1,325 ● driver's license suspension for 2 years ● Satisfy IDRC requirements ● imprisonment of 48 hours to 90 days ● community service for 30 days ● installation of ignition interlock device -1 to 3 years - or revocation of vehicle registration and plates for 2 years ● additional conditions may be imposed
3rd or Subsequent Offense - Blood Alcohol Reading of 0.08% or higher ● $1325 fine ● driver's license suspension for 10 years ● imprisonment 180 days ● Satisfy IDRC requirements ● installation of ignition interlock device -1 to 3 years - or revocation of vehicle registration and plates for 10 years ● additional conditions may be imposed Additional penalties may be imposed for refusal to take the breathalyzer test and driving intoxicated in a designated school zone.
